USE OF NIBA TRADEMARKS
This Agreement is made as of the date Member clicks the “Accept” button on this website (the “Effective Date”), by and between the National Introducing Brokers Association, a not-for-profit corporation organized and existing under the laws of Illinois (“NIBA”); and Member, a member of NIBA or an authorized representative for a Member of NIBA with authority to bind such Member (“Member”).
NIBA owns all right, title, and interest in, and to, the NIBA (and Design) trademark and the MEMBER OF THE NIBA slogan (the “Marks”), each as exemplified below:
MEMBER OF THE NIBA
Member wishes to display the Marks solely on its business website for the limited purpose of indicating its membership in NIBA’s nationally recognized association of professionals in the derivative industry (“Requested Permission”).
NIBA hereby grants the Requested Permission to Member, which is revocable at any time, non-sublicensable, non-transferable and strictly limited as set forth herein. Member’s permission to use the Marks expire either (a) upon NIBA’s request for any reason by providing five (5) days’ notice, or (b) immediately upon Member’s membership in the National Introducing Brokers Association ceasing. Member acknowledges and agrees (a) that NIBA has exclusive right, title, and interest in and to the Marks, (b) that it will not at any time do or cause to be done any act or thing contesting or in any way impairing or tending to impair any part of such right, title, and/or interest or the goodwill associated with the Marks, (c) that all uses of the Marks by Member shall inure to the benefit of NIBA, and (d) that use of the Marks on Member’s website does not represent or imply endorsement or recommendation by NIBA of Member’s firm, personnel, trading system or advice. Member also represents that, at the time it clicks the “Agree” button, it is a Member of NIBA or an authorized representative for a Member of NIBA with the authority to bind such Member.
